Small Disadvantaged Business Program Self-Certification  FAR Case 20009-019

DoD, GSA, and NASA have adopted as final, without change, an interim rule amending the Federal Acquisition Regulation (FAR) to incorporate changes made by the Small Business Administration (SBA) to its small disadvantaged business (SDB) program.

Effective Date: November 2, 2011.

DoD, GSA, and NASA published an interim rule in the Federal Register at 75 FR 77737 on December 13, 2010, to implement in the FAR revisions made by the SBA regarding certification of Federal subcontractors.  The FAR revisions, as identified in the interim rule, allow for small disadvantaged businesses (SDBs) to self-represent their SDB status to prime contractors in good faith when seeking Federal subcontracting opportunities.

DoD, GSA, and NASA received no comments in response to the interim rule and the rule has been adopted as final.

Set-Asides for Small Business  FAR Case 2011-024

DoD, GSA, and NASA have issued an interim rule amending the Federal Acquisition Regulation (FAR) to implement section 1331 of the Small Business Jobs Act of 2010 (Jobs Act). Section 1331 addresses set-asides of task- and delivery-orders under multiple-award contracts, partial set-asides under multiple-award contracts, and the reserving of one or more multiple-award contracts that are awarded using full and open competition.

Effective Date: November 2, 2011.

Comment Date: This interim rule allows interested parties to submit written comments to the Regulatory Secretariat on or before January 3, 2012 to be considered in the formation of a final rule.

MALVERN, Ark.- The Arkansas Procurement Assistance Center, or APAC, is ready to help Arkansas businesses compete for government contracts to provide cleanup, construction and repair services in the wake of flooding and other storm damage.
